1. Acceptance of Terms

By registering, accessing, browsing, bidding, or purchasing on GemSouq, you agree to this Buyer Policy and our Terms of Use, Privacy Policy, and all applicable laws. Users who do not agree must not use GemSouq.

2. Eligibility & Registration

1. Buyers must be legally competent to enter contracts.

2. Buyers must provide complete, truthful, and current information during registration. Intentional dishonesty may lead to account suspension or termination.

3. Bidding, Offers & Purchases

1. Every bid or offer constitutes a legally binding agreement to purchase if accepted.

2. Buyers agree to pay the full amount owed, including item price, final value fees, taxes, duties, and shipping charges.

4. Payments

1. Payments must be made upon winning an auction or placing a buy-it-now order.

2. No chargebacks, reversals, or fraudulent payments. Attempts to reverse a legitimate payment will result in loss of buyer privileges and legal action.

5. Delivery & Shipping

1. Buyers must provide complete and accurate shipping details. GemSouq and the registered Sellers are not responsible for delays, losses, or failed deliveries caused by incorrect or incomplete address information.

2. Buyers are solely responsible for all customs duties, taxes, import regulations, and clearance requirements in their country if any. Any delay, seizure, or return due to customs non-compliance is the Buyer’s responsibility.

3. Buyers must promptly inspect shipments upon delivery. Any shipping damage, missing items, or discrepancies must be reported through GemSouq’s Official Help Desk within the specified timeframe; late claims may be rejected.

6. Returns & Refunds

a. Unless otherwise expressly stated in the listing, all sales are final and non-refundable.
b. If a return policy applies, buyers must:

• Notify GemSouq within the specified return period, which is 15 days.

• Return items in original condition with all certification and packaging intact.

• Solid Proof of why buyer want refund, be attached with refund claim. 

7. Buyer Conduct

Buyers must not:

1. Misrepresent facts about received items or engage in fraudulent behavior.

2. Use offensive, abusive, or harassing communication.

3. Contact sellers off-platform to avoid fees or protections.

8. Privacy

By using GemSouq, Buyers consent that their personal data may be shared with Sellers for order fulfillment in accordance with our Privacy Policy.

9. Limitation of Liability

GemSouq is not responsible for:

1. Item authenticity (unless certified by GemSouq Authentication Service).

2. Losses due to shipping delays, customs seizures, or third-party service failures.

10. Disputes & Governing Law

1. All disputes must be raised via the GemSouq Help Desk within specified deadlines.

2. GemSouq’s decision is final and binding.

3. This Policy is governed by the laws of the jurisdiction where GemSouq operates.
